1878 Snohomish Debt Suit Seeks Auction of Mortgaged Goods

A legal summons from 1878 reveals the precarious nature of pioneer commerce, where a $100 loan could lead to the loss of goods, chattels, and livelihood.

The story, cleaned up

A cleaned-up reading of the newspaper page: spelling and layout repaired, one story lifted off a crowded page. It follows the original closely but it is not a transcription. The original page is below; read it if a detail matters.

In the District Court of Snohomish County, Washington Territory, a legal action was brought by the partners L. M. Pickard and D. D. Jackson against Harvey W. Light and Edward Shane. The lawsuit sought to recover a judgment of $100 in gold coin, with interest at a rate of one and one-half percent per month dating back to April 1877. The plaintiffs moved to seize goods and chattels described in a mortgage previously executed by defendant Light, seeking to sell them at public auction to satisfy the debt, interest, and legal costs. The court clerk, H. A. Gammour, issued the summons in August 1878, warning the defendants that failure to respond within the prescribed time would result in a judgment by default.

“The said action is brought to recover a judgment against you, the said defendants, for the sum of One Hundred dollars United States Gold Coin.”

This 1878 debt dispute highlights the extreme volatility of early Snohomish credit, where interest rates of 1.5% per month—compounding into a life-altering burden—were standard. Today's residents might recognize this as an early, brutal iteration of the debt-traps and high-interest credit systems that continue to complicate housing and financial security in our region.
