Chehalis County Sues the Northern Pacific Over a Road It Says the Railroad Took
The county wants $12,000, charging the railroad with occupying the county road at Porter Creek bluff without providing an equally good replacement.
Suit was brought in the superior court Tuesday of last week by Chehalis County against the Northern Pacific to recover $12,000 damages because of the occupancy of the county road at the Porter Creek bluff by the railroad, and the failure of the company to provide a road equally as good as the one taken.
““…the failure of the company to provide a road equally as good as the one taken.””
Railroads shaped Washington’s growth, but their broad rights-of-way often came at public expense. The county’s demand for compensation anticipates today’s fights over who pays when private infrastructure closes or degrades a public route.
